Exclusive: Guardian and El País find regional speaker was targeted in ‘possible domestic political espionage’

One of Catalonia’s most senior politicians has been warned his mobile phone was targeted using spyware its makers say is only sold to governments to track criminals and terrorists.

A joint investigation by the Guardian and El País has revealed that the speaker of the Catalan regional parliament, Roger Torrent and at least two other pro-independence supporters were told they were targeted last year in what experts said was a “possible case of domestic political espionage” in Europe.

According to a US lawsuit, the spyware exploited a previous vulnerability in WhatsApp software that would have given the operator potential access to everything on the target’s mobile phone – including emails, text messages and photographs. It could also have turned on the phone’s recorder and camera, turning it into a listening device.

Torrent, who was warned about the targeting by researchers working with WhatsApp, said it seemed clear the “Spanish state” was behind the alleged attack on his phone, and that he believed it had most likely occurred without any judicial authority.

Ever
stranger circumstances come to light, statements have been hidden, the
imam was an agent of the secret service, the surviving terrorists were
not charged with murder



It is no longer a secret that the head of the terrorist attacks in the summer three years ago in Barcelona and Cambrils was an agent of the Spanish secret service .






The
Público newspaper revealed a year ago that the intelligence agency and
other Spanish security forces had been in contact with the Imam
Abdelbaki Es Satty until the attacks in August 2017, which Telepolis
reported in detail (
Spanish intelligence agency controlled terror cell .


Público has now added and published
that a key statement on Es Satty’s work for Spanish intelligence in the
mountain of investigation files has been hidden by 100,000 pages and
has been ignored by the Public Prosecutor and the Civil Guard. The
newspaper does not consider it to be a coincidence, after all, it was a
main witness, the questioning of which was expressly requested by the
Belgian authorities from Spain.


Público
rather assumes that the statement should remain hidden. It is therefore
not mentioned in a summary of the investigation as part of a request
for legal assistance and it does not appear in the table of contents of a
CD on which it is stored. Neither the judge nor the lawyers knew about
the existence of the statement. And no translation of the statement was
sent to the judge responsible.


It
is the five-page testimony of Soliman Akaychouh, the director of a
mosque in Diegem near Brussels, where Es Satty wanted to preach.
Akaychouh was questioned just three days after the attacks and in the
statement published by Público stated that Es Satty said she was in
contact with the Spanish secret service over the phone. "He told me that
he spoke to the Spanish secret service, who among other things wanted
to know where he was,"
said the head of the mosque.





The
imam was suspicious of the head of the mosque because of his radicalism
and extremism. That is why he contacted the Belgian police. She then
started an inquiry to the Catalan police. However, this did not result
in anything, since the Mossos d'Esquadra, as is known, had not been
informed by the Spanish colleagues about the activities of the
well-known radical Islamist and former drug dealer. As
reported by Telepolis ,
the Mossos were also dependent on access to key data and resources at
the Center for Combating Terrorism and Organized Crime (CITCO).


Behind this was an incredible process in which Spanish national police officers warned radical Islamists in 2015 of the investigation by the Catalan police . The
troop was raised with the "Operación Caronte" and wanted to carry out
attacks on Jewish institutions in Barcelona and the Parliament.
The Islamists were also
in contact with a neo-Nazi, friend of the chief of the troops , to get weapons and explosives. And surprisingly, he was not accused of "supporting terrorism".















The major parties prevent the imam from being involved with the security forces


These
events are part of a series of curiosities about Islamist activities in
Catalonia and Es Satty. Because since 2003 he was known to Spanish
security forces as a radical Islamist. He was in
contact with radical Islamists and was friends with one of those who caused the 2004 massacre in Madrid with 191 deaths
. Strangely enough, Es Satty was released early from jail, where he was
sitting for drug trafficking. And his deportation to Morocco, which had
been expressly stated in the sentence after the sentence, was
also not implemented because he did not assume any "danger" .


There are still many oddities. There
is the fact that all major parties in the Spanish parliament also
refuse to investigate the imam's involvement with the security forces.
Then there is the fact that
the surviving members of the terrorist cell are not charged with murder even though they killed 17 people - including a German woman - and were planning huge attacks. They were prevented because part of the force blew up in the bombing the night before.


"We doubt that Ripoll's Imám is dead"


The
newest and most interesting oddity, however, is that now there are
serious questions as to whether Es Satty, the intelligence agent,
actually blew up when bombing Alcanar, which has always been assumed.
Lawyer Jaume Cuevillas said on Catalan television:
"We doubt that the Imám of Ripoll is dead." Cuevillas represents the family of the young Xavier Martínez, who was also murdered during the terrorist voyage on the Ramblas.


He
found no evidence in the investigation files, such as DNA evidence that
could prove that Es Satty was actually in the house at the time of the
explosion. According to the investigators, four to five terrorists are
said to have been there. However, only remains of two people were found
in the pile of rubble, of whom only one could have been identified.
Witnesses also testified that the imam's car left shortly after the
explosion, which was later found in a neighboring village.


The cell phone of Es Satty was also not found in the pile of rubble. The lawyer reports from the investigation files that the phone was still called four days after the explosion. The
email address that the terror chief used to have contact with the
secret service, as Público had uncovered, was also used after the
explosion.
It is also
striking for Cuevillas that no one claimed the body of the imam, but the
imam's niece bought two plane tickets the night after the explosion and
hours before the attack in Barcelona.
Because of all of this, the lawyer expressed "justified doubts" that Es Satty is dead.

impunity and protect human rights defenders worldwide. The OMCT is writing to
you on this occasion to reiterate[1] its serious concerns regarding the breaches of the rights of freedom of
expression and peaceful assembly in the case of Mr. Jordi Cuixart i Navarro,
President of the non-governmental organisation Òmnium Cultural[2].

This morning the president of the United States threatened state-sanctioned murder in response to “looting,” laying
bare the way in which white supremacy, capitalism and the state work
together to violently repress people who defend Black life.



But Trump’s angry outburst is not the only blatantly racist response
we should be interrogating. We also must confront the way in which both
conservatives and liberals have responded to the Minneapolis uprisings
by condemning “looting.”



Protesters in Minneapolis and around the country are rising up
against a lynching and other forms of state violence. How should we
respond to a lynching? Should our goal simply be to publicize it, in the
hope that such publicity will generate condemnation and prevent future
lynchings? This logic is flawed, in part, because lynchings thrive off
of spectatorship. For white supremacists, the act of killing is also an
act of fellowship and opportunity for indoctrination.



Simply spreading images of racist killings and asking the state to
stop killing us is not going to stop them. (In fact, while it’s
important to publicize the fact that these killings are occurring,
sometimes the spread of such images also galvanizes white supremacists.)



And so, for some who oppose racist killings, watching the videos,
waiting to vote, and marching in protest feels like enough. But for
others, more intervention is needed. The murder of George Floyd by
Minneapolis police comes on the heels of the killings of Ahmaud Arbery in Brunswick, Georgia, and Breonna Taylor in
Louisville, Kentucky. These killings were committed by current and
former law enforcement. Understandably, outrage is growing.



We should expect uprisings. We should expect property to be damaged,
as people rise up against the racist systems complicit with racist
violence. Many of the people taking part in these revolts have decided
that respecting property is not more important than respecting Black
life. There is an awareness that if the law doesn’t respect Black life,
then the law itself cannot be relied on for protection or given undeserving respect. So, as protesters are being accused of “looting” and “rioting” in Minneapolis or anywhere else, this time demands that we reflect on the systematic robbery of Black America.



Corporations in the United States, again, have walked away with an
unprecedented and astronomical amount of money in 2020. With no
accountability in sight, there was little to no opposition to their
monumental robbery. They were handed trillions. Politicians working in
service to the corporate elite — and afraid of appearing opposed to a
deal that would largely benefit Wall Street — pushed it through. Of
course, the deal left many vulnerable people in the dust. No changes
were made after the unresolved debt crisis of 2008 that
brutalized people around the world with the starvation we know as
austerity. Cuts to social needs have fallen on the public undeterred
while the rich continuously grow richer than they’ve ever been.

No, We Should Not Condemn Uprisings Against Police Murders Like George Floyd's


The uprising in response to George Floyd’s murder by a Minneapolis
police officer this week has led to predictable calls to condemn
looting. But the real looting in our society comes from the military,
the police, the pharmaceutical companies, private equity, the landlords,
the real estate speculators, and the billionaires — not protesters
against police brutality. 

 
 

In the aftermath of a Minneapolis police officer’s murder of George
Floyd, some of our nation’s media have turned to some crucial questions
which must be addressed:


Should we condemn looting?


Yes, we should condemn the looting of the Global South by Western
militaries and multinational corporations. We should fear the terrifying
possibility that the COVID-19 vaccine will be enclosed, privatized, and
sold for profit; and the looting of underdeveloped nations and
underinsured people that would ensue.


We should fight back against the looting of underdeveloped nations’
coffers by odious debts and structural adjustment programs being drawn
up and imposed by international institutions at this very minute.


But should we care about the other kind of looting?


It would take a heartless monster not to care about the looting of
homes and buildings by vulture capitalists. We should organize against
the impending wave of evictions that will crash into our communities as
soon as courts reopen. And we should fight back against the theft of
stable homes and schools; the unnecessary destruction of lives due to
their prioritizing food over rent.


We care that whole working-class communities will be gentrified,
their buildings replaced with housing for wealthier, whiter families,
who bring in a bigger haul of loot for the landlord. We should be
outraged that police are looting homeless people’s encampments, and we
must demand that safe vacant homes and rooms no longer be hoarded away
from unhoused people.


Should we care about actual looting?!?


Of course! Private equity stands to make a fortune off the bankruptcy
of businesses around the country. By firing workers and raiding their
pensions, they’ll make off with the bag. We care about the attempt to
loot the United States Postal Service, for example, destroying countless
good union jobs and an essential public service in order to dismantle a
publicly owned institution and turn it into a private business to
generate profit.




We are outraged by the ongoing looting of local and state government
welfare programs by a federal Republican Party that wishes to see them
destroyed and a House Democratic leadership whose solution to this issue
is to give the rich in blue states a gigantic tax break. We are
disgusted that representatives who claim to stand for workers and
oppressed people will gladly allow their standards of living to collapse
while passing tax cuts for the rich.


Without organizing a powerful labor fightback, we will see the actual
looting of public coffers while the billionaire class has become $434
billion richer during the pandemic.

The protests that have engulfed American cities in the past week are
rooted in decades of frustrations. Racist policing, legal and
extra-legal discrimination, exclusion from the major avenues of wealth
creation and vicious stereotyping have long histories and endure today.









African
Americans have protested against these injustices going back as far as
the post-Civil War days in the 1870s. Throughout the 20th century, there
were significant uprisings in Chicago (1919), New York City's Harlem
neighbourhood (1935), Detroit (1943) and Los Angeles (1943, 1965, 1992).



And in what became known as the "long, hot summer of 1967", anger in America's cities boiled over. The Civil Rights Act
of 1964 had ended segregation, but not brought equality. Racial
injustice at the hands of police remained. Protesters took to the
streets in more than 150 cities, leading to violent clashes between black residents and largely white .


White moderates condemned these armed rebellions as the antithesis of
the famed nonviolent protests of civil rights activists. But Martin
Luther King, Jr., himself, recognized that the success of nonviolence
lay in the ever-present threat of violence.


He noted, too, that riots "do not develop out of thin air."


Policing practices a trigger for unrest


The trigger for African-American uprisings in the US has almost always been acts by police forces, such as the recent death of George Floyd in Minneapolis.


Sometimes, unrest has broken out when police have refused to act on
behalf of black residents. When an African-American teenager drifted
into the "white" part of Lake Michigan in Chicago in 1919, for instance, a white man on the banks threw rocks at him and he drowned. A policeman did nothing to stop the assailants, nor did he arrest them.







From the perspective of those targeted and traumatized by police and
discriminated against by society at large, property damage and looting
were justified.


In the century after slavery ended in 1865, white Americans had established new ways to exploit black people's labor and keep African Americans impoverished. These methods ranged from legislation governing work contracts and mobility to racist stereotyping.


Such laws and customs were all underpinned by violence, including murder. From the late 1800s until 1950, more than 4,000 African Americans
were victims of lynchings. They were so acceptable they were sometimes
advertised in the press in advance. These were extra-judicial killings,
but often included the police (or they would at least turn a blind eye
to the proceedings).


Black Americans who sought better lives in northern cities found
racism there, too. White landlords had a captive market in segregated
neighborhoods, such as New York's Harlem and Chicago's South Side, which
caused them to become increasingly crowded and rundown.


African Americans were often kept out of nicer neighborhoods in
cities nationwide, either through violent acts perpetrated by white
residents or even by police officers themselves. The houses of
middle-class black Americans in the Birmingham, Alabama, suburb where
political activist and philosopher Angela Davis grew up were bombed so
often the area was nicknamed "Dynamite Hill".


Even the presence of black officers in the police forces of northern cities could not alter the fundamentally racist operations of police forces.

'For a man sentenced to nine years in prison for a political crime, Jordi Cuixart, one of the figureheads of Catalonia’s separatist movement, seems in remarkably good spirits.
When I visited him yesterday in the Lledoners penitentiary centre, about 40 miles from Barcelona, he launched into an animated speech about the benefits of yoga, pottery and meditation for maintaining a positive frame of mind.
“If ever I’m feeling a bit down, I remember how many of the world’s political prisoners are forced to endure much worse conditions than us,” he told me through a telephone on the other side of a glass screen.
“We can’t complain, even if we are here despite being innocent of any crime.” '

CATALONIA --- THE REPRESION OF CATALONIA NATION

'Constitutions do not have a secession clause because states want to keep themselves.  Spain is no exception.  Spain refuses the secession of the Catalan nation, of course, but not for constitutional reasons: it is a question of power.  Minority nations must therefore mobilize and politically impose their right to self-determination.

Quebec did not ask Ottawa for the right to hold a referendum.  They mobilized and organized two popular referendums peacefully and democratically.
Some states, such as Canada, have a longer liberal democratic tradition, are more tolerant of their minority nations and allow for independence referendums, which they hope to win by playing the argument of fear of the unknown.  Ottawa did not use its courts in 1980 and 1995, but put its weight in the balance to tilt the vote towards the status quo.

It has been said that the Catalan independence referendum was unconstitutional.  The Spanish Constitution is silent on this issue.  It mentions "the indissoluble unity of the Spanish nation", but this kind of typical clause can not be dealt with solely under the judicial angle.  The relationship between a majority nation, under the control of the powerful central state, and a minority nation is a problem that must be solved politically.  Especially since a constitution is a peace treaty, which freezes power relations at the time of its adoption and embodies the interests and vision of the majority group.
The Spanish Constitution of 1978 was adopted in the context of the end of Franco's fascist regime and an insurrectional threat of Franco's generals.  It emphasizes the unity of the Spanish nation and the primacy of the Castilian national language to appease the reactionary forces.'
'Under Franco, the Catalans were harshly repressed: their language and culture were banned from public space and their government exiled.  The 1978 Constitution gave them back their linguistic, cultural and political rights.  Faced with the threat posed by the Franco forces, this constitution represented a short-term gain for Catalonia, but proved insufficient in the long run.
The autonomy statute of 2006 recognized the Catalan nation and its government, which existed legitimately well before 1978, and gave it greater autonomy.  As it responded to Catalan claims, a small percentage of the population declared themselves independent.  The campaign against this status by the conservative political forces, crowned by its invalidation in 2010 by the Constitutional Court, explains the meteoric rise of Catalan independence movement.

Faced with this crisis, the elites of Madrid have turned a deaf ear to Catalan requests for dialogue or to launch a referendum on independence.  The Catalans were condemned to accept this injustice in silence.
The Catalan referendum of 2017 was therefore a normal political response to this blockage.  At the height of injustice, Madrid responded to peaceful Catalan political action with its judges - who imprisoned Catalan leaders for several years - and its policemen - who club a peaceful people.  Madrid has also dissolved and put under guardianship the regional government of Catalonia, which was democratically elected and committed to the Catalan people to set up a referendum on the independence of the state-region.

The Spanish state violates the right to self-determination of Catalans and locks itself into a rigorous interpretation of its constitution.  Meanwhile, Western states, like Canada, are closing in a complicit silence.'
