German digital newspaper Telepolis has published an article that is highly critical of the Spanish state for the policies of judicialization and repression which it has used in its response to the Catalan conflict. The article, entitled "Spain: 'No matter who governs, the response is always repression'
" (link in German), deplores the poor political management of both
Socialist prime minister Pedro Sanchez and his predecessors and reports
on the anomalous election campaign - for next Sunday's European and municipal votes - that the country is experiencing.


"The Socialist government likes to talk about dialogue, but at the
same time it applies repression against the Catalans," the article
states. The newspaper believes that the judicialization of the
independence process - combating it in the courts rather than
undertaking political negotiation - has been a bad strategy. It says the trials currently underway of pro-independence leaders are "absurd".


"Now they have charged 28 more Catalans with being part of a criminal organization, president Quim Torra is accused of disobedience
for not removing yellow ribbons from public buildings... And in these
cases, the judicial powers act very quickly," says the German newspaper.
In addition, it considers that Spain's Central Electoral Commission, a political protagonist in recent weeks​,
is not competent to rule on these types of cases and recalls that "the
three parties holding the majority in the Catalan Parliament support the
political prisoners." "No matter who governs, the response is always
repression" the Catalan president is quoted as saying.

The Telepolis article says that the actions of Spain's Electoral Commission were illegal and biased: "Without any legal basis, the commission tried to exclude Carles Puigdemont from the European elections. The public prosecution service was very clear that there were no grounds to prohibit him
from running: neither Puigdemont, nor Clara Ponsatí, nor Toní Comín" -
mentioning the three exiled Catalan government members who are running
for European office.


Finally, the German newspaper celebrates the fact that the exiled president and his former cabinet ministers can, in the end, take part in the European elections
next Sunday and recalls that a legal case has been presented by Carles
Puigdemont against the Electoral Commission members representing
right-wing Spanish parties Cs and PP who denied him the right to stand
in the elections.

Puigdemont’s list files lawsuit against electoral authority

 

 

CATALONIA

'Carles Puigdemont, the former Catalan president,
will take part in the European election after successfully challenging
the electoral authority’s original decision to bar him from his party’s
list.

But his clash with the body regulating all elections in Spain does not end here.


Junts, his political group, filed a lawsuit against two members of the
electoral board for a breach of official duty, accusing them of
“partiality” and “hostility” against him.

The lawsuit also says
that the two members of the body, Andrés Betancor and Carlos Vidal, had
been “previously contaminated by their ideological and political
beliefs.”

Betancor was proposed in Congress by unionist Ciutadans
(Cs) party, while Vidal was put forth by the People’s Party (PP) – both
parties have been challenging Puigdemont’s bid in the EU election.'

"Much better": the judge’s comment that could annul the Catalan trial

' "Much better". Two short words that could be a bombshell. They were
spoken by presiding judge Manuel Marchena in the Supreme Court during
Tuesday’s session of the Catalan independence trial. Marchena made the
comment in response to Benet Salellas, the defence lawyer for Jordi
Cuixart, after a tense exchange between judge and lawyer which Salellas
ended by saying "I won’t ask any further questions." Marchena then
dropped in his two word epithet: "Much better".

The defence
team coordinator for the ERC party, Joan Ignasi Elena, told Barcelona
radio station RAC1 on Wednesday morning that this response is "a very
serious procedural error in the trial" and recalled that "for a similar
phrase, the case against [Basque pro-independence leader] Arnaldo Otegi
was annulled, because it shows that the judge lacks impartiality." In
November 2018, the European Court of Human Rights ruled that Spanish
justice hadn’t given Otegi a fair trial, after he had already served
more than six years in prison, because the trial judge had once
responded to a comment from the defendant with the phrase "I knew you
were going to say that."
Lawyer Elena says the way is now open for
the Strasbourg court to annul the verdict in the trial of the 12 Catalan
independence leaders as a result of the reaction of the presiding
judge.

University of
Barcelona law professor Joan Queralt also pointed out this same
procedural error. In a tweet sent on Tuesday, he said that "for
something similar, the European Court of Human Rights rendered void the
sentence against Otegi".'
